1. Scope
These terms govern the use of the website diytracker.ch (the "platform") by visitors and by invited contributors who submit, edit or approve events. By using the platform you accept these terms.
2. Scope of service
The platform provides a non-commercial event calendar for DIY concerts in Switzerland. No claim can be derived to uninterrupted availability, to any particular feature set, or to the completeness or accuracy of the displayed event data.
3. Accounts and access
Contributors receive a password-protected account by invitation. They are required to keep their password confidential and not to transfer their account to third parties. Any suspicion of misuse must be reported to the operator.
4. Submission of content
Contributors who submit events, text or flyers warrant that they hold the necessary rights to the submitted content or have obtained the permission of the rights holders. By submitting, they grant the operator a non-exclusive, royalty-free, worldwide right to display and reproduce the content on the platform and in its promotional or archival contexts for as long as the platform is operated.
5. Moderation
The operator reserves the right to reject, edit, shorten or remove submissions without giving reasons — in particular where they are incomplete, misleading, unlawful or incompatible with the purpose of the platform.
6. Disclaimer
The platform aggregates event data from third-party sources and from manual contributions. The operator makes no warranty as to the currency, accuracy or completeness of displayed information. Liability for damages arising from reliance on such information — for example travel costs to cancelled or mis-dated events — is excluded to the extent permitted by law.
7. Takedown procedure
On justified notice of an infringement of personal rights, trademark rights or copyright, the affected content is reviewed and removed promptly. Please direct requests to kontakt@diytracker.ch stating the concrete URL and the reason.
8. Changes to these terms
The operator may amend these terms at any time. Changes are published on the platform; continued use is deemed acceptance.
9. Governing law and jurisdiction
Swiss law applies, excluding conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for all disputes arising from or in connection with the use of the platform is [the operator's seat, e.g. Zurich], save where mandatory legal provisions require a different venue.
